Acceptance of Terms
By creating an account or using our services, you confirm that you are at least 18 years old, have the legal authority to enter into these Terms, and agree to comply with all applicable laws and regulations. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization.
Permitted Use and Restrictions
You may use Clearspark only for lawful business purposes in accordance with these Terms. You agree not to: reverse engineer or attempt to extract source code; use our services to transmit malicious software; violate the intellectual property rights of others; use our services to engage in fraudulent, abusive, or deceptive activities; or resell or sublicense our services without written authorization.
Intellectual Property
Clearspark retains all intellectual property rights in our platform, software, and documentation. You retain ownership of all data and content you submit to our platform. By using our services, you grant us a limited license to process your data solely to provide the services described herein.
Service Availability and SLA
We commit to 99.97% monthly uptime for our core platform services. Scheduled maintenance windows are communicated at least 72 hours in advance. In the event of SLA breaches, eligible customers may request service credits in accordance with our SLA policy, available at clearspark28.com/sla.
Limitation of Liability
To the maximum extent permitted by law, Clearspark's total liability for any claims arising from these Terms or your use of our services shall not exceed the amounts paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration in San Francisco, California, except where prohibited by applicable law.
Modifications
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before changes take effect. Continued use of our services after that date constitutes acceptance of the updated Terms.
